In order to implement the Outline for Building a Strong Intellectual Property Country (2021-2035) issued by the Central Committee of the Communist Party of China and the State Council, as well as the National Intellectual Property Protection and Application Plan for the 14th Five Year Plan (hereinafter referred to as the Plan) issued by the State Council, the Office of the Inter Ministerial Joint Conference on the Construction of a Strong Intellectual Property Country formulated the 2024 Plan for Promoting the Construction of a Strong Intellectual Property Country (hereinafter referred to as the Plan), which was officially issued on May 11, 2024.
This plan starts from seven aspects: improving the intellectual property system, strengthening intellectual property protection, improving the operation mechanism of the intellectual property market, improving the level of public services for intellectual property, creating a good cultural and social environment for intellectual property, deeply participating in global intellectual property governance, and strengthening organizational protection. It deeply implements the strategy of building a strong intellectual property country, accelerates the construction of a strong intellectual property country, and clarifies the key tasks and work measures for 2024.
1、 Improve the intellectual property system
Improve intellectual property laws, regulations, and rules. Promote the revision of the Trademark Law of the People's Republic of China and the Implementation Regulations of the Trademark Law of the People's Republic of China; Promote the revision of the Implementation Regulations of the Copyright Law of the People's Republic of China and the Regulations on Collective Administration of Copyright; Promote the formulation of the Regulations on the Protection of Copyright in Folk Literature and Art Works; Promote the revision of the Anti Unfair Competition Law of the People's Republic of China; Promote the legislative process of the Regulations on the Protection of Traditional Chinese Medicine Knowledge.
Reform and improve major policies on intellectual property rights. Strengthening the coordination between the central and local governments and establishing a mechanism for evaluating and assessing trademark examination cooperation; Formulate and issue the Guiding Opinions on Promoting the High Quality Development of the Copyright Industry; Revise the Interim Measures for Voluntary Registration of Works, establish a nationwide unified copyright registration information service platform, and coordinate and improve the registration and filing system.
Improve intellectual property rules in emerging and specific fields. Deeply promote the construction of data intellectual property protection rules, improve the rules of intellectual property protection in the Internet field, and study and formulate guidelines for further strengthening intellectual property work in the fields of culture and tourism.
2、 Strengthen intellectual property protection
Strengthen judicial protection of intellectual property rights. Further promote and deepen the reform of the national level case appeal review mechanism, and strengthen the construction of a professional trial system; Accelerate the research on intellectual property special procedure law that conforms to the laws of intellectual property adjudication.
Strengthen administrative protection of intellectual property rights. Strengthen professional guidance on law enforcement work related to trademarks, patents, and other fields. Strengthen patent administrative adjudication work; Strictly crack down on the illegal act of sending counterfeit and inferior goods, and use modern information technology to enhance regulatory capabilities.
Establish a sound pattern for collaborative protection of intellectual property rights. Continuously promote the diversified resolution of intellectual property disputes, strengthen the construction of intellectual property dispute mediation organizations and arbitration institutions, and do a good job in connecting intellectual property litigation, arbitration, and mediation.
3、 Improve the operational mechanism of the intellectual property market
Improve the quality of intellectual property creation. Continuously improving the quality and efficiency of patent and trademark examination, expanding and accelerating the examination scale, supporting the development of strategic emerging industries, and exploring the application of large model technology in examination work; Establish a sound monitoring and credit evaluation mechanism for the quality of patent and trademark copyright agency, introduce quality oriented bidding guidelines for agency services, promote the improvement of the service quality and level of agency agencies, and consolidate the achievements in cracking down on abnormal patent application agency and malicious trademark application agency behavior.
Strengthen the comprehensive application of intellectual property rights. Deeply implement the special action of patent transformation and utilization, with the goal of patent industrialization; Deepen the implementation of trademark and brand value enhancement actions and geographical indications to support rural revitalization actions.
Promote market-oriented operation of intellectual property rights. Promote the interconnection and open sharing of the national intellectual property operation service platform system; Strengthen innovation in intellectual property pledge financing services, guide banks to explore internal evaluation models for intellectual property pledge financing, and guide the development of financing guarantee products suitable for intellectual property.
4、 Improve the level of intellectual property public services
Strengthen the supply of public intellectual property services. Strengthen the analysis and application of intellectual property data, explore the use of big data technology mining to form a comprehensive evaluation system for science and technology innovation enterprises with intellectual property as the core indicator, and accurately support the development of science and technology innovation enterprises.
Improve the efficiency of intellectual property public services. Carry out intellectual property related work related to the World Bank's global business environment assessment; Introduce more intellectual property financial service products to settle in the national intellectual property pledge information platform, and expand the platform's service capabilities.
5、 Creating a favorable cultural and social environment for intellectual property rights
Vigorously promote the concept of intellectual property culture. Fully utilize important time nodes such as National Science Popularization Day and National Intellectual Property Promotion Week to carry out intellectual property popularization activities, rely on the Science Popularization China Information Platform, and strengthen the full media dissemination of intellectual property popularization resources.
Consolidate the foundation of intellectual property development. Deepen the implementation of the knowledge updating project for professional and technical talents, and increase the training and training of high-level professional and technical talents in the field of intellectual property. Improve the evaluation system for intellectual property talents and strengthen the construction of a professional lawyer team for intellectual property.
6、 Deeply participate in global intellectual property governance
Actively promote the adjustment of the cooperation mechanism among the five intellectual property bureaus of China, the United States, Europe, Japan, and South Korea. Actively participate in discussions on relevant issues under multilateral platforms such as the World Trade Organization and the Asia Pacific Economic Cooperation (APEC), deepen bilateral exchanges and cooperation on intellectual property with trade partners such as the European Union, Japan, Russia, and Switzerland in the field of economic and trade, and continue to promote the implementation of the China Europe Agreement on Geographical Indication Protection and Cooperation and negotiations on intellectual property issues under the Free Trade Agreement. We will deepen international cooperation on intellectual property rights along the the Belt and Road, hold the Third High level Conference on Intellectual Property Rights along the the Belt and Road, and plan more practical cooperation projects.
7、 Strengthen organizational support
Carry out annual monitoring and evaluation of the implementation of the Outline and Plan, strengthen statistical monitoring of indicator data, and supervise and inspect the implementation of work tasks. Collect and promote the third batch of typical cases for the construction of a strong intellectual property country. Implement detailed tax and fee preferential policies, continuously optimize management and service measures, and continuously create a good tax environment for the construction of an intellectual property strong country.
The 2024 Plan for Promoting the Construction of a Strong Intellectual Property Country clarifies the goals and tasks of building a strong intellectual property country from multiple aspects, providing comprehensive guidance and guarantees for promoting the protection and utilization of intellectual property rights. Only by deeply implementing this strategy and accelerating the construction of a strong intellectual property country can we effectively promote economic development and innovation drive, and achieve high-quality development of the Chinese economy.
